Position Title: Legal & Regulatory Compliance Manager
Position Overview:
The Legal and Regulatory Compliance Manager will oversee all legal and regulatory compliance activities within the organization, ensuring the company operates in full compliance with applicable laws, regulations, and internal policies. This position will play a critical role in managing legal affairs, securing development permits, ensuring regulatory compliance, and mitigating risks. As a key member of the management team, the Legal and Regulatory Compliance Manager will provide strategic guidance to support business operations and drive organizational growth.
Key Responsibilities
Legal Affairs
Provide legal counsel on corporate, contractual, real estate, and regulatory matters.
- Draft, review, and negotiate contracts, agreements, and other legal documents to protect the company's interests.
- Manage and oversee litigation, arbitration, and dispute resolution processes.
- Ensure compliance with all applicable local, national, and international laws governing business operations.
Coordinate with external legal counsel when specialized expertise is required.
Permitting and Regulatory Compliance
Oversee the timely acquisition, renewal, and submission of all permits and regulatory documentation, including:
- Zoning and Locational Permits: Zoning Certification, Locational Clearance. Land Conversion Approvals:
- DAR Conversion Clearance (if required). Environmental Compliance:
- Environmental Compliance Certificate (ECC) or Certificate of Non-Coverage (DENR).
- Subdivision Development Approvals: Approved Subdivision Development Plan, Development Permit from the LGU.
- Utility Clearances: Water Supply Certificate, Electrical Supply Certificate.
- DHSUD Requirements: License to Sell, including Sworn Registration Statement, Surety Bond, and Feasibility Study.
- Local Clearances: Barangay Clearance, Right-of-Way Certification.
- Monitor updates to laws and regulations impacting land development and implement necessary adjustments.
Ensure compliance with zoning, environmental, and building code standards across all projects.
Risk Management and Stakeholder Coordination
Identify and mitigate potential risks in securing permits and maintaining regulatory compliance.
- Develop and maintain strong relationships with government agencies (DHSUD, DENR, DAR, LGUs) and regulatory bodies.
Collaborate with internal teams (legal, engineering, project development) and external consultants to ensure smooth documentation and compliance processes.
Documentation and Reporting
Prepare and maintain organized records of all legal, regulatory, and permitting documentation for audit and compliance purposes.
- Regularly update senior management on the status of permits, compliance initiatives, and legal activities.
Ensure timely renewals of permits and licenses to avoid project disruptions.
Strategic Leadership
Lead and manage the regulatory compliance and legal teams, fostering collaboration and accountability.
- Support the development of company policies and procedures to strengthen compliance frameworks.
- Provide strategic advice to executives and department heads to ensure alignment with regulatory requirements and business goals.
Qualifications
- Juris Doctor (JD) or equivalent legal degree
- Licensed lawyer
- Minimum of 5 years of experience in legal and regulatory compliance roles, with at least 5 years in a leadership position.
- Proven expertise in real estate development, corporate law, and regulatory compliance, particularly in the Philippine context.
- Strong knowledge of DHSUD, DENR, DAR, LGU, and other relevant regulatory frameworks.
- Excellent communication, negotiation, and stakeholder management skills.
- Ability to navigate complex regulatory environments and handle high-pressure situations effectively.
