We are seeking a proactive and detail-oriented In-House Legal Counsel with strong experience in collection agency operations and data privacy compliance. The successful candidate will provide legal guidance across all departments, ensure regulatory compliance, draft and review legal documents, and support the enforcement of collection strategies while safeguarding personal and sensitive data.

Key Responsibilities:

1. Legal Advisory & Corporate Compliance

  • Provide legal advice on business operations, focusing on collection practices and regulatory compliance.
  • Ensure company policies, contracts, and operations are compliant with local laws (e.g., FDCPA, DPA, Civil Code).
  • Review, draft, and negotiate service contracts, NDAs, and third-party agreements.
  • Advise management on legal risks related to client disputes, accounts receivable, and operational policies.

2. Collection and Litigation Support

  • Oversee the legal framework for debt collection processes.
  • Review collection procedures for compliance with fair collection practices and consumer protection laws.
  • Coordinate with external counsel or law firms on litigation and enforcement of receivables.
  • Draft demand letters, settlement agreements, and assist in legal recovery processes.

3. Data Privacy Compliance

  • Serve as the Data Privacy Officer (or collaborate closely with the DPO).
  • Ensure full compliance with the Data Privacy Act of 2012 and other relevant data protection laws.
  • Draft and implement internal data privacy policies, privacy notices, and consent forms.
  • Lead data breach investigations, privacy audits, and employee training on data protection practices.

4. Risk Management & Internal Policy Development

  • Identify and manage legal risks across departments.
  • Lead internal reviews of legal documents and operational practices.
  • Monitor changes in laws and regulations that affect the business, particularly in collections and data privacy.
  • Participate in strategic meetings to ensure legal alignment with corporate goals.

Qualifications:

  • Juris Doctor (JD) degree and licensed to practice law in the Philippines (or applicable jurisdiction).
  • Minimum 5 years of experience as legal counsel or associate, with significant exposure to collection agency operations and data privacy law.
  • Strong knowledge of Data Privacy Act, collection-related laws, consumer rights, and relevant industry regulations.
  • Proven experience in litigation support, contract law, and corporate legal management.
  • Excellent written and verbal communication skills.
  • High level of professionalism, ethics, and attention to detail.
  • Can start ASAP
  • Amenable to work in start up Company.
