Job Summary
The Legal Manager oversees all legal, compliance, and regulatory matters affecting resort and hospitality operations. The role ensures the resort's activities are compliant with Philippine laws, hospitality industry regulations, and corporate standards. This includes reviewing contracts, managing risks, handling guest liability concerns, supporting labor and employee relations, and ensuring compliance with permits, zoning, and environmental regulations. The Legal Manager also acts as liaison with government agencies and external legal counsel to safeguard the resort's interests while enabling smooth business operations.
Duties & Responsibilities
Hospitality Contracts & Agreements
- Draft, review, and negotiate hospitality-related contracts (supplier agreements, catering contracts, group booking agreements, OTA distribution contracts, corporate rate contracts).
- Ensure event contracts and waivers protect the resort from liability.
- Review franchise, management, and lease agreements where applicable.
Guest Liability & Risk Management
- Advise on guest-related legal issues (accidents, food safety, claims, cancellations, refunds).
- Review liability waivers for water activities, events, or third-party partnerships.
- Support incident investigations and documentation in coordination with Operations.
Regulatory Compliance
- Ensure timely renewal of resort permits (LGU, DOLE, DOH, DOT, BIR, DENR).
- Monitor compliance with safety, health, environmental, and zoning laws.
- Maintain accurate documentation for ISO and accreditation requirements.
Labor & Employee Relations Support
- Provide guidance on employment contracts, disciplinary actions, and labor disputes.
- Ensure compliance with labor laws and regulations on service charge, benefits, and staff contracts.
- Represent the company in labor hearings and mediations when necessary.
Litigation & Dispute Resolution
- Manage litigation, guest claims, and property-related disputes with external counsel.
- Support arbitration, settlement, and alternative dispute resolution strategies.
- Represent the resort in hearings with government agencies and regulatory bodies.
Business Expansion & Real Estate Compliance
- Conduct due diligence on land acquisitions, leases, and development projects.
- Ensure compliance with environmental regulations (DENR, zoning, building permits).
- Provide legal support for franchising, partnerships, and investment agreements.
Qualifications
- Bachelor of Laws / Juris Doctor degree; must be a member of the Philippine Bar.
- At least 5 years of experience as a practicing lawyer, with 2+ years in corporate or hospitality-related legal practice.
- Strong background in contract law, labor law, tourism/hospitality regulations, and property/zoning laws.
- Experience with hospitality operations, OTA agreements, and guest liability issues preferred.
Skills & Competencies
- Expertise in hospitality-specific legal matters (guest claims, labor disputes, contracts, permits).
- Strong negotiation and contract drafting skills.
- Knowledge of ISO, DOLE, DOH, DOT, and DENR compliance requirements.
- Excellent communication and interpersonal skills across property and corporate levels.
- High ethical standards, confidentiality, and discretion.
