Job Description:

  1. Assist the Project Manager and Project Director for all Contractual and Commercial matters.
  2. Manage a team of 2 Contract Engineers and Subcontracts Manager.
  3. Assist the project team in forming a strong contractual position by providing the right interpretation of the Contract requirements.
  4. Lead the weekly commercial meeting with the Engineer and Employer and participate in all other required internal and external meetings.
  5. Draft all key formal correspondence to the Engineer, Employer, other stakeholders, and Subcontractors.
  6. Review all other correspondence for the project on all topics.
  7. Manage and track all open correspondence for the project and close the same within the defined timeframe.
  8. Manage the achievement of Milestone Payments.
  9. Manage milestone splits to achieve smooth certification and planned cash flow.
  10. Manage the Interim Payment Application and Certification process.
  11. Manage Bonds, Guarantees, Warranties, Commercial Registration, Insurances, etc. for the Project.
  12. Proactively issue Early Warning (Risk) Notices in accordance with the Contract conditions.
  13. Proactively issue formal correspondence to convert Early Warning Notices into Change or Claim Notices once the impact is realized.
  14. Manage the achievement of Key Dates and Time for Completion and formalize the same with the required submission to the Engineer.
  15. Prepare the Change and Claims management strategy and process.
  16. Lead the preparation of Change Proposals to the Engineer.
  17. Proactively compile the Change Proposals including the time and cost details as required under the Contract for submission to the Engineer.
  18. Lead the meetings for discussing and aligning the Change Estimates with the Engineer.
  19. Proactively chase the Engineer for issuance of the required Change Orders.
  20. Proactively track and manage all issues leading to Change and request Change Instruction from the Engineer.
  21. Prepare and submit Claim Notices and Detailed Particulars (cost and time) as per the Contract conditions.
  22. Manage disputes and their amicable settlement and if not resolved, prepare for arbitration.
  23. Manage the Correspondence, Change and Claims management logs.
  24. Support the Project Manager to manage project risks and achieve closure of the Early Warning Notices.
  25. Manage the Project Completion Certificate, Final Taking Over Certificate, Final Account, Performance Certificate, etc.
  26. Manage the Subcontractors and ensure that all contractual and commercial aspects related to all Subcontracts for the Project are being administered appropriately.

Required Skills/Knowledge:

  1. Minimum of 15 years of relevant experience working on large-scale Infrastructure projects around the world, especially in the Middle East region.
  2. Previous experience working in the Railway business (preferred).
  3. Membership of RICS, CIOB, CIArb, or equivalent relevant professional institution (preferred).
  4. In-depth knowledge of standard methods of measurement (SMM7, NRM, POM(I), CESMM).
  5. In-depth knowledge of FIDIC standard forms of contract.
  6. High level of literacy skills in English.
  7. Demonstrative verbal and written communication skills.
  8. Previous experience in a system contractor organization or claims consultancy practice (preferred).

Education/Qualifications:

  1. Bachelor’s Degree in Engineering, Law, Quantity Surveying, or equivalent related field.
  2. Master’s degree in Law (preferred) or Engineering.
